Terms & Conditions of Participation in the LCC “ Christmas Giveaway”

(hereinafter referred to as “LCC”)
1. General
Thank you for your interest and your participation in our LCC “Christmas Giveaway” (in the following “LCC giveaway”).
Participation in the LCC giveaway is possible during the days of Friday, December 15 2023 (10:00 CET) to Friday, January 5 2024 (10:00 CET).
In context of the LCC giveaway, the prize will be drawn from among the duly registered participants who have left a comment in the comment sections of the post (either tagging a friend or sharing the country were they celebrate Christmas). The prize includes one JBL Speaker, one Backpack and one 30 Euro amazon voucher. The winners will be selected and contacted within one week (7 days). Each winner will receive all details about redemption and the general conditions in the event of a win via a direct message on Instagram.
2. Terms & conditions of participation
a. The LCC giveaway is open to all persons aged 18 and over. Participation in the LCC giveaway is only possible via commenting on the Instagram giveaway post, shared on Friday, December 15, between the period of December 15, 2023 and January 5, 2024.
b. The recipient of the information provided by all users in connection with the LCC giveaway is LCC. The information provided will be used exclusively in connection with the LCC giveaway and for communications in connection with this LCC giveaway and in accordance with Section 7 of the Data Protection Notice (name, address, and email address).
c. Employees of the LCC Headquarters are excluded from participation.
d. Participation in the LCC giveaway is free of charge. The chance of winning and participation is independent of the purchase of goods or services. The participant themselves must bear the costs of participation, such as Internet connection or mobile phone.
e. The participant is responsible for the correctness of the contact data provided.
f. By participating in the LCC giveaway, participants accept these conditions of participation and confirm that they have read the data protection information. Each person can participate only once in the LCC giveaway.
g. The winner must respond within 1 week (7 days) of notification of the prize, otherwise the prize will be forfeited.
h. LCC is entitled to exclude participants from the LCC giveaway without notice if they do not meet the requirements of these terms & conditions of participation or if they manipulate or attempt to manipulate the LCC giveaway, in particular its participation process, especially by taking part several times, and/or culpably violate the rules of participation.
3. LCC giveaway prizes and LCC giveaway procedure
One winner per prize (mentioned in 1. General) will be selected.
a. The participant in the LCC giveaway will be informed after the LCC giveaway if a prize has been won.
b. LCC assumes no liability whatsoever for the delivery of the prizes to the respective winner. To the extent permitted by law, LCC likewise accepts no liability for the availability of prizes.
c. In the event that a prize is undeliverable, LCC is not obliged to make any enquiries. In addition, the winner’s claim to the prize shall be forfeited if the prize cannot be sent correctly due to incorrect data. In the event of an undeliverable prize, another winner will be drawn by lot.
d. The prize is non-transferable, cannot be redeemed for vouchers, and cannot be used separately.
4. Liability
a. Claims for damages against LCC are excluded, except in cases of intent or gross negligence. LCC and its respective legal representatives and vicarious agents shall only be liable for damage suffered by the participant if the damage was caused by LCC, its legal representatives, or vicarious agents intentionally or through gross negligence. This limitation of liability does not apply to damages in the form of injury to life, body, or health. Furthermore, it does not apply in the event of breach of material contractual obligations. In such a case LCC’s liability shall be limited in amount and cause to such damages as were typical and foreseeable at the time of conclusion of the contract of use. A material contractual obligation is an obligation the fulfilment of which is essential for the proper fulfillment of the contract and the observance of which the contractual partner may rely on in principle.
b. LCC cannot guarantee that the offer will be available at all times.
c. LCC cannot be held liable in any way whatsoever for losses or damage arising in connection with the LCC giveaway or a transmission error or other, particularly technical difficulties (e.g. overloading), or loss of data.
d. By participating in the LCC giveaway, the participant indemnifies LCC from all claims, including claims for damages. All further rights and claims for damages by LCC remain unaffected.
5. Premature termination of the LCC giveaway
a. LCC reserves the right to cancel or suspend the LCC giveaway at any time without prior notice. This applies in particular if, for technical reasons (e.g. viruses in the computer system, manipulation, or errors in the hardware and/or software), for reasons of manipulation of the participation process, or for legal reasons, due execution of the LCC giveaway cannot be guaranteed.
b. The participant’s claims to performance and compensation in the event of premature termination of the promotion in accordance with Section 6.a. are excluded within the framework of the provision of Section 5.a.
6. Miscellaneous
a. A cash payment, an exchange for other material assets, or a transfer of the prize to another person is not possible. In the unlikely event that the prize is unavailable, LCC reserves the right to replace it with a prize of equal or higher value at its own discretion.
b. These terms & conditions of participation may be amended by LCC at any time with prior notification if the due execution of the LCC giveaway can no longer otherwise be guaranteed. For the same reason, the LCC giveaway may also be suspended or completely cancelled by LCC.
c. Should individual provisions of the terms & conditions of participation be or become invalid, the validity of the remaining terms & conditions of participation shall remain unaffected.
d. These terms & conditions of participation and the legal relationship between the participant and LCC are subject exclusively to German law, excluding the UN Convention on Contracts for the International Sale of Goods.
e. Legal recourse is excluded.
f. This giveaway is not performed in collaboration with Instagram.
7. Data protection information
a. As the responsible body within the meaning of the BDSG (new) and the GDPR, LCC collects, processes, and uses all personal data provided to LCC in the context of this LCC giveaway always in accordance with the applicable data protection regulations. Personal data for the purposes of LCC giveaway procedure will be processed by LCC in accordance with Art. 6 (1) p. 1 lit. b) GDPR. Personal data in this sense are the following personal data provided by participants in the context of the LCC giveaway: name, address, and email address.
b. LCC will not pass on this personal data to third parties. The collection, processing, and use of your data is solely for the purpose of LCC giveaway procedure. The data provided by the participant will not be stored or used for any other purpose.
c. The personal data of the participant will be deleted after the end of the LCC giveaway, provided that this does not conflict with any statutory retention periods, particularly with regard to compliance with tax regulations.
d. As a participant, you are entitled to the following data subject rights:
- Right to access information, Art. 15 GDPR
- Right to rectification, Art. 16 GDPR
- Right to erasure (“right to be forgotten”), Art. 17 GDPR
- Right to restriction of processing, Art. 18 GDPR
- Right to data portability, Art. 20 GDPR
- Right to object Art. 21 GDPR

In order to be able to process your application, as well as for identification purposes, we would like to point out that we process your personal data in accordance with Art. 6 Para. 1 lit. c) GDPR and delete it after 3 years.
e. In the event of a request for erasure before the end of the LCC giveaway, this request for erasure will mean the termination of participation in the LCC giveaway if the request for erasure prevents further participation.
