Copyright of your website

When operating a website you need to make sure don’t violate copyright laws in the design of your site.

Improper image use is a common legal problem. It may sound obvious, but you should never download an image from Google and place it on your site. These images may be owned by other sites or may be stock images that are licensed to other businesses. By placing them on your own website, you could be violating copyright laws.

You also need to be careful with stock imagery when finding and purchasing stock images for your site. While there are free stock image sites out there, high-quality sites do better with imagery purchased from a site like Getty Images or Shutterstock.

Make sure that you are using purchased and properly licensed images from these sites. These companies are able to track down misused images through the metadata and take legal action for misuse.

If you are working with a web design team, make sure that you are aware of where they are finding their images and what type of licensing each image has. For instance, certain Getty images are licensed for use on a website, but an additional license is required to use the image in printed marketing or advertising. You’ll need to make sure you aren’t unknowingly violating those terms by taking images from your site and placing them in marketing materials.

Add Cookie Consent Box

It is important to keep in mind that a Cookie Policy isn't only required for businesses based in the EU. Having this policy is also necessary for any website getting traffic from users from an EU member state.

The regulations surrounding cookies make it very clear that a user must take an action which clearly indicates the acceptance of, and consent to, the use of cookies.

User consent can come in many forms, such as replying to an email or clicking an opt-in button on a website.

We recommend using the services of https://www.cookiebot.com/en/. Here you can check your website and see which kind of cookie consent tool you need. If your website is not too complex, the free-of-charge version may do. https://www.cookiebot.com/en/pricing/

Cookie Declaration (Privacy Policy)

Lega Must-Haves for your website

Here is a list of legal requirements that help to protect your customers and web visitors.

Disclaimer:This is not a 100% complete list and may vary from country to country. Please always contact an local attorney to make sure you have the correct legal wording for your website in place.

Privacy Policy

It tells your customers exactly what personal information you collect from them and what you do with it. It’s one of those elements required by law. There are two major reasons why your site needs a Privacy Policy:

1.Federal law, and in some cases state law, governs the manner in which you interact with your website visitors.

  1. Privacy Policies help you build trust with your potential customers. When you tell your visitors what information you collect from them and how you use it, it gives them confidence that your site is a safe and trustworthy place to play, share, and buy.

What it should contain

The contents of your Privacy Policy depend on the particular law in question and, to some extent, the nature of your website.

This snappy list will get you started:

  • An explanation of the information you collect and what it is used for
  • How people can access and change any information previously collected and/or opt out of mailing lists
  • How you will notify visitors of changes in your Privacy Policy
  • A statement about age restrictions — this one is super important and usually involves restricting the site to individuals who are either 13 and older or 18 and older
  • A statement about any “do not track” signals used
  • A statement about how you share any information you collect (Side note: If you use email marketing software or payment software from a third party, then you do share your customer’s information with a third party. A trusted third party is still a third party, so be sure to say so in your Privacy Policy.)

 Terms and Conditions

Terms and Conditions are a contract you make with the visitors to your site. They set out the behaviors you expect from your visitors as well as what your visitors can expect from you.

Solidly drafted Terms and Conditions can limit your overall legal liability, protect your valuable intellectual property, and help you collect payments on time. Without Terms and Conditions, any disputes arising from the use of, or purchases from, your site will likely be more messy and expensive.

What it should contain

As with Privacy Policies, the contents of your Terms and Conditions are dictated what you offer on your website. If the website is purely inspirational the Terms and conditions are not as complex as if you are selling offers directly on your website.  Here’s a list of what your Terms and Conditions should (probably) contain (at the very least):

  • Where and how disputes will be handled (pick a state, any state …)
  • Limitations on warranty and damages
  • Intellectual Property policy, including how yours can and cannot be used and how you may use the intellectual property visitors post on your site
  • Your right to refuse service, including when and how you can exercise it
  • How purchases are processed, if you are a retailer
  • Refund policy
  • How changes in your terms will be communicated
  • Comment policy
